Supreme Court criticizes Haryana police for insensitive investigation

The Supreme Court of India recently criticized Haryana Police for their insensitive and flawed handling of a child rape investigation in Gurugram.

The case involves the alleged rape of a 3- to 4-year-old girl, where parents filed a petition seeking a CBI or SIT probe due to police lapses. The bench, led by Chief Justice Surya Kant with Justices Joymalya Bagchi and Vipul Pancholi, heard the matter in late March 2026.

Key Criticisms

  • Police allegedly pressured the victim’s parents to withdraw the FIR and failed to visit the victim’s home properly; one officer involved was later arrested on corruption charges.

  • The child was shuttled repeatedly between police station, hospital, Child Welfare Committee, and court, causing further trauma, with her statement recorded near the accused in violation of POCSO Act safeguards.

  • The court called the probe “shocking,” “shameful,” and indicative of “blatant insensitivity,” questioning if police acted like “kings.”

Court Actions

The Supreme Court formed a women-led Special Investigation Team (SIT) of IPS officers, directing Haryana to notify it immediately and hand over case records. It issued show-cause notices to Gurugram Police officials, including the Commissioner and Investigating Officer, requiring their personal appearance with full records. The court also sought details on women officers in the state cadre and comments from the Judicial Magistrate.
