Supreme Court Raises Questions On UGC Equity Regulations 2026

The Supreme Court of India has stayed the UGC (Promotion of Equity in Higher Education Institutions) Regulations, 2026, due to concerns over vagueness and potential misuse in addressing caste-based discrimination. A bench led by Chief Justice Surya Kant and Justice Joymalya Bagchi framed four key questions on the regulations’ constitutional validity while halting their implementation.

The bench highlighted ambiguities in defining “caste-based discrimination” separately from the broader “discrimination” term, questioning its rational nexus since no distinct remedies were provided for it. It also flagged the exclusion of Most Backward Classes and Extremely Backward Classes from specific protections, and raised issues with the term “segregation” in hostel and classroom allocations, fearing it could undermine equality under Articles 14 and 15.

The four substantial questions include:

  • Does defining “caste-based discrimination” under Clause 3(c) serve the regulations’ purpose, given the inclusive “discrimination” definition in Clause 3(e)?

  • Do the rules adequately protect sub-classifications like Most Backward Castes within SCs, STs, and OBCs?

  • Does “segregation” in Clause 7(d) infringe equality and fraternity guarantees?

  • Any ancillary issues arising in proceedings.

The regulations aimed to curb discrimination on grounds like caste, religion, and gender in higher education but were challenged for excluding general category students from grievance mechanisms. The Court emphasized moving toward a casteless society and issued notice to the Centre, keeping the rules in abeyance.
